“If there is fraud and criminal intent is proven, it is the duty of the controlling officer to report to the police.” As for the report itself, it appears that there is a definitive course of action that can, and has to be taken to ensure the effectiveness of the report.

Mr Yeo Yang Poh, immediate past president of the Malaysian Bar council, believes that the report should be thoroughly studied by the Government, police as well as the Anti Corruption Agency (ACA) so that they can take different angles of investigation simultaneously.He does not discount the value of the report, but questions the lack of action taken on its findings. “We are fortunate that we have an independent and professional AG’s department that does the job and puts on record irregularities they discover – that has value, but lacks effectiveness,” adds Yeo. “These are public funds and it concerns people who are administering the public trust, and that trust has been breached.

“It is a question of a lack of accountability in a consistent and major way. Accountability can only be accurately determined after a thorough and impartial investigation.” He adds that the same improprieties are happening every year. Some action is taken in a smaller form, that of internal or smaller cases, but to his knowledge, there has been no meaningful or major action taken against any party.

“Sadly, the public has a short memory and only makes noise when the
problems are highlighted in the media. Someone should give a status report on what’s going on.”
